Terms and Conditions
Last updated: 01/07/2026
Welcome to MorteNoir.
These Terms and Conditions explain the rules for using mortenoir.co.uk and buying products from MorteNoir. By using our website or placing an order, you agree to these Terms.
Please read these Terms carefully before ordering. If you do not agree with them, you should not use our website or place an order.
These Terms should be read together with our Privacy Policy, Shipping Information, Returns Policy, Community Post Policy, and any other policies linked on our website.
1. About us
MorteNoir is an independent dark streetwear and alternative fashion brand based in the United Kingdom.
Website: mortenoir.co.uk
Email: support@mortenoir.co.uk
Business address:
Trading name: MORTENOIR LIMITED
Company number: 17292359
Registered office: 124 City Road, London, EC1V 2NX
In these Terms:
-
“MorteNoir”, “we”, “us”, and “our” means MorteNoir.
-
“You” and “your” means the customer or website user.
-
“Products” means the clothing, accessories, digital content, or other goods available through our website.
-
“Order” means a purchase placed through our website.
2. Use of our website
You agree to use our website only for lawful purposes.
You must not:
-
Use our website in a way that breaks any law or regulation
-
Interfere with the security, operation, or performance of the website
-
Attempt to access accounts, systems, or data without permission
-
Copy, scrape, reproduce, or exploit our website content without permission
-
Submit false, misleading, harmful, abusive, discriminatory, or spam content
-
Use our website for self-promotion, fraud, resale abuse, or unauthorised commercial activity
We may suspend or restrict access to our website if we believe these Terms have been breached.
3. Age and account use
By using our website or placing an order, you confirm that you are at least 18 years old or that you are using the website with permission from a parent or guardian.
If you create an account, you are responsible for keeping your login details secure. You must tell us immediately if you believe your account has been accessed without permission.
We are not responsible for losses caused by your failure to keep your account information secure, unless we have failed to meet our own legal obligations.
4. Product information
We try to make product descriptions, images, sizing information, colours, pricing, availability, and other product details as accurate as possible.
However:
-
Colours may appear slightly different depending on your device, screen settings, lighting, and image editing
-
Measurements may vary slightly due to garment type, fabric, washing, production method, or manual measurement
-
Product images may include styling items, props, models, or accessories that are not included unless clearly stated
-
Minor production differences may occur, especially for washed, dyed, printed, distressed, or made-to-order garments
-
Product availability, descriptions, images, and prices may be updated from time to time
Nothing in this section affects your legal rights if a product is faulty, not as described, or not fit for purpose.
5. Made-to-order production
MorteNoir is a made-to-order brand. This means many items are produced after your order is placed rather than mass-produced in bulk.
Made-to-order production helps us reduce waste, avoid unnecessary stock, and support slower, more intentional fashion.
Production time is separate from shipping time. Estimated production and delivery timeframes are shown on our website and/or at checkout where available.
Production and delivery estimates are not guaranteed unless we expressly state otherwise. Delays may happen due to production capacity, fulfilment partners, customs, weather, courier delays, incorrect address details, local holidays, or circumstances outside our reasonable control.
6. Standard, custom, and personalised products
Most MorteNoir products are standard catalogue products, even where they are made to order.
Some products may be custom, bespoke, made to your specific measurements, altered at your request, or clearly personalised. These products may have different cancellation and return rules, which will be explained where applicable.
A product is not automatically “personalised” just because it is made after you place an order. It will usually only be treated as custom or personalised if it is made to your individual specifications, altered for you, or clearly personalised in a way that makes it unsuitable for resale.
7. Pricing
Prices are shown on our website in the currency selected or displayed at checkout.
For UK customers, prices include VAT where applicable.
For international customers, prices may be shown in local currencies for convenience. Currency conversion rates may vary and may be handled by Shopify, payment providers, banks, or other third-party services.
We may change prices at any time, but price changes will not affect orders that have already been accepted.
If a product is listed with an obvious pricing error, we may cancel the order and refund you. If this happens, we will contact you.
8. Payment
Payment must be made in full at checkout unless another payment option is clearly offered.
We accept the payment methods shown at checkout, which may include Shopify Payments, Shop Pay, PayPal, Klarna, Apple Pay, Google Pay, card payments, and other available payment providers.
Payment providers may carry out fraud checks, identity checks, authorisation checks, or other security checks.
We do not directly store your full payment card details.
If your payment is declined, your order may not be processed.
9. Discount codes, promotions, and offers
From time to time, we may offer discount codes, promotions, free shipping, launch offers, subscriber discounts, or other offers.
Unless stated otherwise:
-
Discount codes cannot be exchanged for cash
-
Discount codes cannot be applied after an order has been placed
-
Only one discount code may be used per order
-
Discount codes may have expiry dates, minimum spend requirements, product exclusions, or location restrictions
-
We may withdraw, pause, amend, or refuse a promotion if we believe it is being misused
-
Promotions are subject to availability and may end at any time
If a refund is issued for an order purchased with a discount, the refund will usually reflect the amount actually paid after the discount was applied.
10. Placing an order
When you place an order, you are making an offer to buy the selected products.
After placing an order, you may receive an order confirmation email. This confirms that we have received your order, but it does not always mean the order has been accepted.
Your order is accepted when we confirm dispatch, begin fulfilment, or otherwise confirm acceptance of your order.
We may refuse, cancel, or refund an order where:
-
The product is unavailable
-
There is a pricing or product information error
-
Payment is declined or reversed
-
We suspect fraud, misuse, or unauthorised activity
-
Delivery is unavailable to your location
-
You have breached these Terms
-
We are unable to fulfil the order for reasons outside our reasonable control
If we cancel an order after payment has been taken, we will refund the amount paid.
11. Order changes and cancellations before dispatch
If you need to change or cancel an order, contact us as soon as possible at support@mortenoir.co.uk.
Because many MorteNoir products are made to order, we may begin production shortly after your order is placed.
We will try to help where possible, but we cannot guarantee that changes or cancellations can be made once an order has entered production, fulfilment, or dispatch.
This does not affect any cancellation rights you may have under applicable consumer law.
12. Delivery and shipping
Delivery options, shipping costs, estimated timeframes, available destinations, and tracking information are explained on our Shipping Information page and/or at checkout.
Production time and shipping time are separate.
Estimated delivery timeframes are not guarantees unless we expressly state otherwise.
You are responsible for providing accurate and complete delivery information. We are not responsible for delays or failed delivery caused by incorrect or incomplete address details provided by you.
If your parcel is returned to us because of an incorrect address, failed delivery, refusal to accept delivery, unpaid customs fees, or failure to collect, we may ask you to pay any reasonable re-shipping costs.
13. Delivery risk
For consumer orders, risk in the products usually passes to you when the products are delivered to you or to someone you have authorised to receive them.
If you arrange your own courier or delivery service that we did not offer or name as an option, risk may pass when the products are handed to that courier.
If your order is lost or damaged in transit before delivery, please contact us so we can investigate with the courier and help resolve the issue.
14. Customs, import duties, and taxes
International orders may be subject to customs duties, import taxes, handling fees, or local charges depending on your country.
These charges are set by local customs authorities and are usually the customer’s responsibility unless we clearly state otherwise at checkout.
You are responsible for checking whether any import rules, taxes, or restrictions apply in your country before ordering.
We are not responsible for delays caused by customs checks, unpaid customs charges, import restrictions, or local delivery requirements.
15. Your right to cancel
If you are a consumer buying online, you may have the right to cancel your order within 14 days after the day you receive your goods, unless an exception applies.
If your order contains multiple items delivered separately, the cancellation period may run from the day after you receive the final item in that order.
To cancel, you must tell us clearly that you wish to cancel. You can contact us at support@mortenoir.co.uk.
If you cancel under your statutory cancellation rights, you must return the goods within 14 days after telling us you wish to cancel.
Unless the product is faulty, not as described, or we made an error, you are responsible for return shipping costs.
We may withhold your refund until we have received the returned goods or until you provide evidence that you have sent them back.
We may reduce the refund if the value of the goods has been reduced because you handled them more than necessary to check their nature, characteristics, fit, or function.
16. Exceptions to cancellation rights
Some products may not be eligible for cancellation or return unless faulty, not as described, or otherwise required by law.
This may include:
-
Products made to your specific measurements or individual specifications
-
Clearly personalised products
-
Sealed goods that are not suitable for return for health or hygiene reasons once unsealed
-
Underwear, swimwear, masks, or hygiene-sensitive items where applicable
-
Products that have been worn, washed, stained, damaged, altered, scented, or used beyond reasonable inspection
-
Products that are not returned in a condition suitable for resale, unless faulty
We will not use this section to remove rights that you legally have.
17. Returns
If you want to return an item, please contact us at support@mortenoir.co.uk before sending anything back.
If a return is approved, we will provide return instructions and the correct return address.
Returned items should be:
-
Unworn
-
Unwashed
-
Unaltered
-
Free from stains, odours, pet hair, makeup, deodorant marks, damage, or signs of wear
-
Returned with tags and original packaging where possible
Please do not send items back without contacting us first. Unauthorised returns may be delayed, refused, or returned to you where appropriate.
We recommend using a tracked delivery service for returns.
18. Refunds
Where a refund is due, we will usually refund you to your original payment method.
Refund timing may depend on your bank, payment provider, or checkout provider.
If you paid using a gift card, store credit, split payment, instalment payment, or third-party payment method, the refund may be processed according to that provider’s rules.
Original delivery charges may be refunded where required by law. Additional premium delivery costs above standard delivery may not always be refunded unless legally required.
19. Faulty, damaged, or incorrect products
We are responsible for supplying products that meet your legal rights, including products that are as described, of satisfactory quality, and fit for their intended purpose.
If your order arrives faulty, damaged, incorrect, or not as described, please contact us as soon as possible at support@mortenoir.co.uk.
Please include:
-
Your order number
-
A description of the issue
-
Clear photos where relevant
-
Photos of the packaging if the item arrived damaged
We may offer a repair, replacement, refund, partial refund, or another fair solution depending on the issue and your legal rights.
Asking you to contact us quickly helps us resolve the issue faster, but it does not remove any statutory rights you may have.
20. Sizing, fit, and care
Please check product descriptions, size guides, measurements, and care instructions before ordering.
You are responsible for choosing the correct size unless we have provided incorrect or misleading sizing information.
Garments may change slightly after washing, wearing, drying, or improper care. Please follow the care instructions provided with the product or shown on our website.
We are not responsible for damage caused by normal wear and tear, misuse, incorrect washing, incorrect drying, alteration, accidental damage, or failure to follow care instructions.
21. Product availability
Products are subject to availability.
We may limit quantities, pause products, remove products, change designs, update prices, or discontinue items at any time.
If a product becomes unavailable after you order, we will contact you and may offer a refund, replacement, alternative product, store credit, or another suitable solution.
22. Reviews and community content
MorteNoir may allow customers and community members to submit reviews, photos, outfit images, selfies, recent purchase images, captions, usernames, social handles, comments, and other content.
By submitting content to MorteNoir, you confirm that:

-

We may reject, edit for formatting, remove, or refuse to publish community content at our discretion.
If content was connected to a gifted product, discount, collaboration, payment, affiliate relationship, or other incentive, you must disclose this when submitting.
You may request removal of a community post by contacting us at support@mortenoir.co.uk.

29. Events outside our control
We are not responsible for delays or failure to perform our obligations where this is caused by events outside our reasonable control.
This may include:
-
Courier delays

If an event outside our control affects your order, we will try to contact you and take reasonable steps to reduce the impact.
30. Changes to these Terms
We may update these Terms from time to time.
The updated version will be posted on this page with a new “Last updated” date.
The Terms that apply to your order will usually be the Terms in place at the time you placed that order, unless a change is required by law or another valid reason applies.
31. Severability
If any part of these Terms is found to be invalid, unlawful, or unenforceable, the remaining parts will continue to apply.
32. No waiver
If we do not immediately enforce any part of these Terms, this does not mean we have waived our right to enforce it later.
33. Governing law
These Terms are governed by the laws of England and Wales.
If you are a consumer, you may also have mandatory rights under the laws of the country where you live, and nothing in these Terms removes those rights.
